New Zealand’s New Vaping Regulations Effective from December 17, 2024

The New Zealand government has announced significant changes to its vaping regulations, aimed at reducing exposure to vaping products among children and young people. These changes will be implemented in two phases: December 17, 2024, and June 17, 2025. The updates include stricter penalties, location restrictions for vape stores, and a ban on disposable vaping devices.


Key Changes in the Regulations

1. Restrictions on Vape Store Locations

  • Since December 17, 2024, new specialized vape retail (SVR) stores have not been able to open within 100 meters of early childhood education centers (ECE).
  • The existing rule requiring a 300-meter distance from schools and community gathering centers remains in effect.
  • These restrictions apply only to new stores and do not affect general retailers or existing vape stores.

2. Stricter Penalties for Violations

  • Selling to Minors:
    • Company fines have increased from $10,000 to $100,000.
    • Individual penalties for other offenses have doubled from $5,000 to $10,000.
  • Minor Sales Without Prosecution:
    • Retailers can now face fines of up to $2,000 for first-time offenses, up from $500.
  • Advertising Violations:
    • Manufacturers or distributors can still be fined $200,000, while large retailers face fines of $70,000.
    • Small retailer penalties have increased from $15,000 to $50,000.

3. Ban on Displaying Vaping and Heated Tobacco Products

  • Starting June 17, 2025, the display of vaping devices, products, and packaging will be prohibited:
    • In general retail stores.
    • In SVR stores, if visible from outside.
    • Online and in vending machines.

4. Ban on Disposable Vaping Devices

  • From June 17, 2025, the manufacture, sale, and distribution of disposable vaping devices will be banned.
  • Refillable POD systems will remain legal, encouraging the use of reusable devices.

5. Restrictions on Promotions and Discounts

  • As of June 17, 2025, vaping products cannot be promoted through discounts, giveaways, or special offers.

6. Registration Requirements for General Retailers

  • Retailers selling vaping, herbal, or smokeless tobacco products must register with the Ministry of Health.
  • They must provide their trade name and business address as part of the registration process.
